Yes. A foreigner can own a condominium unit freehold as long as foreign owners together hold no more than 49% of the total unit area of the building (Condominium Act B.E. 2522, s. 19 bis). The purchase money has to be brought into Thailand in foreign currency, and the bank's evidence of that transfer is shown at the Land Office.
A foreigner cannot own land in their own name (Land Code B.E. 2497, s. 86). Villas are usually bought through a registered lease of the land, and one lease term cannot exceed 30 years (Civil and Commercial Code, s. 540). The Thai Supreme Court has held that pre-agreed renewals designed to go beyond 30 years are not enforceable.
The Land Office charges a 2% transfer fee on the officially appraised value. On top of that the seller's side pays either specific business tax of 3.3% (when the property is sold within 5 years of purchase) or stamp duty of 0.5%, plus withholding income tax. Who pays which part is agreed in the sale contract.
Nobody can upload a property to this site directly: every listing passes through Private Office Property first. What we check before publishing, where listings come from and how we are paid is described on the How we work page.
